Terms of Service
These Terms of Service (“Terms”) govern access to and use of LEGACY Intelligence, legacyintelhq.com, and related services provided by Legacy Intelligence LLC. By using the service, you agree to these Terms.
1. Purpose of LEGACY
LEGACY is a fishing-intelligence and educational tool designed to help anglers record their own fishing experiences, conditions, decisions, catches, and observations and use that evidence to develop fishing knowledge.
2. Eligibility and Accounts
You are responsible for providing accurate account information, safeguarding account credentials, and activity conducted through your account. You may not use the service in violation of applicable law.
3. Your Fishing Data and Content
You retain your rights in fishing information, notes, trip records, catch records, and other content you submit. You grant LEGACY the limited rights reasonably necessary to host, process, analyze, reproduce, and display that content to operate and improve the service and provide features to you.
LEGACY does not acquire ownership of a user's fishing spots merely because coordinates or trip information are recorded.
4. LEGACY Intellectual Property
The LEGACY name, branding, software, interface, algorithms, designs, documentation, text, graphics, and other service materials are owned by or licensed to Legacy Intelligence LLC and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of LEGACY intellectual property to you.
5. Acceptable Use
- Do not interfere with, disrupt, probe, attack, reverse engineer, or circumvent security or access controls except to the extent a restriction is prohibited by applicable law.
- Do not use LEGACY to violate fishing, boating, navigation, trespass, wildlife, licensing, or other laws.
- Do not upload unlawful, malicious, infringing, or fraudulent content.
- Do not attempt to obtain another user's private fishing information or precise locations without authorization.
6. Fishing, Navigation, Weather, and Safety
LEGACY is not a marine navigation system, emergency service, weather-warning service, legal-regulations service, or substitute for seamanship, local knowledge, official charts, notices to mariners, or government guidance. Fishing intelligence, predictions, recommendations, maps, conditions, tides, weather, locations, and other information may be incomplete, delayed, inaccurate, or unsuitable for current conditions.
You are solely responsible for safe navigation, vessel operation, checking current weather and marine conditions, determining water depth and hazards, obtaining licenses and permissions, avoiding restricted or private areas, complying with current fishing regulations, and deciding whether and where it is safe and lawful to fish.
7. No Guarantee of Fishing Results
Fishing conditions change. LEGACY does not guarantee that a plan, pattern, recommendation, location, lure, presentation, prediction, or prior result will produce fish or repeat a prior outcome.
8. Third-Party Information and Services
The service may use or reference information or services provided by third parties. LEGACY does not control every third-party source and does not guarantee that third-party information is current, complete, or error-free.
9. Availability and Changes
We may modify, suspend, discontinue, test, or update features as the product develops. We do not guarantee uninterrupted or error-free availability.
10. Subscriptions and Payments
If paid features or subscriptions are offered, the price, billing period, renewal terms, cancellation method, and applicable store terms will be presented at purchase. App-store billing may also be governed by the terms of the applicable platform.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” LEGACY DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND RESULTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEGACY INTELLIGENCE LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, BUSINESS, FISHING OPPORTUNITY, OR USE, ARISING FROM OR RELATED TO THE SERVICE.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Legacy Intelligence LLC from third-party claims arising from your unlawful use of the service, your violation of these Terms, or your infringement of another person's rights.
14. Termination
You may stop using LEGACY at any time. We may suspend or terminate access when reasonably necessary for security, legal compliance, material violations of these Terms, or protection of the service or other users.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
16. Changes to Terms
We may update these Terms as the service changes. The effective date above identifies the current version. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
